Tuolumne County Superior Court Mediation

Yesterday, I did a mediation that involved an attorney and his client over a fee dispute. Having taken previous training on "Fee Disputes", the training was valuable when the client sued the attorney as he felt the retainer that he had paid was not worthy of the attorney's services.

Within 2 hours both parties reached an agreement. Prior to mediation the attorney desired binding arbitration.

Mediation brought about a better understanding, open communication and resolve.

Mediation with a "neutral" was key along with compromise.

The Tuolumne County Superior Court in Sonora has a new Alternative Dispute Resolution program and mediation has been very effective in high rates of settlement versus the time involved with litigation.

As a mediator, I have been told that I have a communication gift for resolving disputes. I treat each party with respect, honesty and I listen.

"Winning at Mediation"

One of the pleasures in my mediation practice is meeting other mediators, sharing ideas and often learning from their experience and wisdom.


Today I recieved from Nancy E Hudgins a San Francisco mediator-attorney who shared a compiltation of essays on mediation preparation.

The pamphlet started with an idea from her blog http://www.civilnegotiation.com/ on a series of post on preparing for mediation.

From developing a pre-mediation checklist, listening skills, matching the mediator, creating value, strategies to developing a plan.

I enjoyed the chapter that "Mediation is Not"

A armed conflict, hand -to-hand combat nor is it Moot Court.

Nancy explains that mediation is a different skill. One that is more collegial, cooperative, and collaborative.

Nancy believes that to always be positive and to stay positive.

I have learned that when I tell parties in a "Dispute" that by the end of the mediation we will settle this conflict today, it sets out a positive outcome.

Nancy invites the reader to "Construct your own plan" for successful negotiation or mediation.
